1. Introduction & Our Role
Prime Source ("we", "our", or "us") operates as a Business-to-Business (B2B) search engine and public data aggregator. This Privacy Policy explains how we collect, process, and safeguard information in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA) of South Africa.
2. Types of Data We Process
We process two distinct categories of information:
- Subscriber Data: Information you provide when creating an account (e.g., your name, email, billing details). We use this strictly to provide our services to you and manage your subscription.
- Public Business Data (Leads): Business contact information (e.g., company names, public email addresses, business phone numbers, public addresses) aggregated from publicly available sources across the internet.
3. Lawful Processing of Public Business Data
Under POPIA, juristic persons (companies) are protected as data subjects. However, Prime Source relies on the exemptions provided in Section 12(2)(a) and Section 15(3)(b) of POPIA, which permit the collection and processing of information that is contained in a public record or has deliberately been made public by the data subject. We do not aggregate private consumer data; our focus is strictly on publicly accessible commercial entities.
4. Limitation of Liability & Subscriber Responsibilities
Prime Source acts solely as an informational search tool. We do not send direct marketing on behalf of our users. By using our platform, you (the Subscriber) legally agree that:
- You are the "Responsible Party" under POPIA when you choose to initiate contact with any business found via our platform.
- You will comply with Section 69 of POPIA and the Consumer Protection Act (CPA) regarding unsolicited electronic direct marketing.
- You will provide a clear, functional opt-out or unsubscribe mechanism in every communication you send.
- Prime Source accepts no liability for how you utilize the aggregated data. Any legal claims arising from unsolicited marketing sent by a Subscriber are the sole responsibility of that Subscriber.
5. Data Subject Rights & Takedown Requests
While the business data we index is publicly available, we respect the rights of all data subjects. Any business or individual can request that their information be corrected or permanently removed (delisted) from the Prime Source search index under Sections 11 and 24 of POPIA. We process all valid takedown requests promptly.
6. Data Security
We implement strict, industry-standard security measures to protect both Subscriber Data and our search index. All sensitive communications and database transactions are encrypted using 256-bit SSL technology to prevent unauthorized access or data breaches.
